These Terms and Conditions (“Terms”) govern the website www.thedailygrinder.co (the “Site”) operated by The Daily Grinder (“we,” “us,” or “Company”). By accessing or using the Site on any device, you agree to be bound by these Terms. If you do not agree, please do not use or access the Site. Your use of the Site constitutes your agreement to follow and be bound by these Terms.
1. Governing Law and Jurisdiction
These Terms and your use of the Site are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. The courts of general jurisdiction located in Fredericksburg, Virginia will have exclusive jurisdiction over any and all disputes arising out of or relating to these Terms and/or the Site.
2. Modifications to Terms
We may modify these Terms at any time by publishing a revised version on the Site. We encourage you to review the Terms whenever you use or access the Site. By continuing to use the Site after the effective date of any modifications, you agree to be bound by the modified Terms.
3. Assignment
The Daily Grinder may assign its rights and duties under these Terms and Conditions to any party at any time without notice to you.
4. Age Restrictions
By accepting these Terms you certify that you are 21 years of age or older. If you are under the age of 21, you may not access, purchase or use the Site or any products offered by The Daily Grinder. We do not sell or distribute products to minors.
5. Intellectual Property and Content
Unless otherwise noted, the design of the Site, including information, data, text, photographs, videos, audio clips, posts, articles, software, scripts, graphics and interactive features (collectively, “Content”) are copyrights, trademarks, service marks or other intellectual property owned, controlled or licensed by The Daily Grinder. The Content is intended solely for your personal and non-commercial use. No right, title or interest in any Content is granted or transferred to you due to your use of the Site.
Except as noted above, you may not reproduce, publish, transmit, distribute, display, modify, sell or participate in any sale of any of the Content or the Site. Your misuse of the Content may subject you to liability under federal, state or international laws.
6. Product Information and Accuracy
We do our best to ensure that information on the Site is complete, accurate and current. However, information on the Site may occasionally be inaccurate, incomplete, or out of date. All specifications, products, descriptions and prices of products on the Site are subject to change at any time without notice. We make all reasonable efforts to accurately display the attributes of our products, including colors, but we cannot guarantee that your system will display colors accurately.
The inclusion of any products or services on the Site at a particular time does not imply or warrant that these products or services will be available at any time. We reserve the right to discontinue any product at any time.
7. Shipping and Delivery
When an order is placed, it will be shipped to the address you provide, subject to compliance with federal, state, and local laws governing hemp-derived products. We currently ship only within the United States and only to jurisdictions where the sale and shipment of hemp-derived products (≤ 0.3% Δ9-THC by dry weight) are legal. We reserve the right to restrict, limit, or cancel orders (in whole or in part) to certain products or jurisdictions at any time without prior notice if compliance concerns arise.
Customer responsibility. It is your responsibility to confirm that products you order are lawful to import, possess, and use in your state or locality. If a shipment is seized or delayed due to legal restrictions in your jurisdiction, The Daily Grinder will not be liable for replacement or refund.
We use reputable third-party carriers and provide tracking once your order ships. Delivery times may vary due to carrier delays, weather, peak volumes, or postal restrictions.
7.1 Restricted / No-Ship States (subject to change)
Because state rules change frequently and can differ by product type (e.g., vapes, edibles, “intoxicating hemp” like Δ8/THC-A vs. non-intoxicating CBD), we restrict shipping as follows:

Note: Laws change often, and some states regulate by potency, ratio, or product form (e.g., labeling/testing/ratio rules in Virginia; artificially-derived cannabinoids in Oregon; or local public-health orders). We may expand or reduce this list without notice to maintain compliance. For the most current status, check your local laws and this page before ordering. VDACS+1
8. Email Communication
By purchasing on the Site or otherwise creating an account on the Site, you understand that we may send you communications or data regarding our products and services. You agree to receive such communications from us.
Unless such email is necessary to facilitate a transaction (for example, to complete a sale or provide information related to a purchase), we will give you the opportunity to opt-out of receiving commercial emails by following the opt-out instructions provided in such message(s). Opting out may prevent you from receiving emails regarding special offers, improvements or other updates.
You also agree that all notices, disclosures, agreements and other communications that we provide to you by email satisfy any legal requirement that such communications be in writing. Your consent to receive communications and do business by email applies to all of your interactions and transactions with The Daily Grinder. Please keep us informed of any changes in your email address so you may continue to receive our communications without interruption.
9. Order Confirmation and Acceptance
When you place an order, you should receive an acknowledgement email confirming receipt of your order. The Company only accepts your order once payment has been approved and we have debited the payment card (or otherwise processed the payment). At that point the contract is made based on these Terms.
We reserve the right, without prior notice, to limit the order quantity on any product and/or to refuse service to any customer. In the event we make a change to or cancel an order, we will attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was placed. We may also require verification of information prior to acceptance and/or shipment of any order.
The products sold through the Site are intended to comply with applicable U.S. laws and regulations, including those of Virginia. If you are a non-U.S based user, be advised that other countries may have laws, regulatory requirements, and product-safety requirements that are different than those in the U.S.
Product availability on our Site is not guaranteed (stock may be low). If a product is not available by the time your order processes, we will notify you via email. You will receive a shipping confirmation email once your items have shipped.
10. Compliance and Availability — Virginia Hemp-Specific Disclosures
10.1 Compliance with Virginia Laws
Our operations are subject to the laws of the Commonwealth of Virginia governing industrial hemp and hemp-derived products. For example:

Retail facilities offering for sale regulated hemp products (including edibles or products intended for smoking or inhalation) must obtain a Regulated Hemp Product Retail Facility Registration from the Virginia Department of Agriculture and Consumer Services (VDACS) under Va. No person may sell at retail a regulated hemp product that exceeds 0.3% total Δ9 THC on a dry-weight basis or, for certain regulated products, more than 2 mg of total THC per package unless the product maintains a CBD:THC ratio of at least 25:1. VDACS

Products intended for smoking or inhalation must meet specific packaging, labeling and testing requirements, including child-resistant packaging and independent laboratory certificates of analysis (COAs) from an ISO/IEC 17025 accredited laboratory. VDACS+1

10.2 Product Labeling & Safety
Products we offer will include appropriate labeling indicating:

the amount that constitutes a single serving;

total THC content and percentage of THC per serving and per package;

the product may only be sold to persons age 21 or older when it contains THC;

10.3 Customer Responsibility
By purchasing from our Site, you agree that you will comply with all applicable federal, state and local laws governing possession, purchase, delivery and use of hemp-derived products. If you are ordering from outside Virginia (or outside the U.S.), you acknowledge that your jurisdiction may impose additional restrictions and you assume responsibility for compliance and possible seizure or penalties.
10.4 Continued Monitoring
We continuously monitor our supply chain and regulatory updates in Virginia. However, you have the right to verify third-party COAs, product origin, THC content and compliance status of any product you purchase.
11. User Comments
We allow users to post comments, suggestions, ideas, materials and other submissions (“User Comments”) on the Site. These User Comments are provided on a non-confidential basis and by submitting User Comments you are granting us an irrevocable and unrestricted license to fully exploit such User Comments. You agree that no User Comments submitted by you to the Site will violate any right of any third party, including copyright, trademark, privacy or other personal or proprietary rights. You further agree that no User Comments submitted by you to the Site will be unlawful, abusive or obscene. You are and shall remain solely responsible for the content of any User Comments you make.
Although User Comments may be posted on the Site, the posting of those submissions does not constitute our endorsement of such User Comments. We are not responsible or liable for any claim — including, without limitation, loss or injury to tangible or intellectual property, violations of personal privacy or privacy rights, actual, consequential or punitive damages or wrongful death made in connection with User Comments. We reserve the right to remove any User Comments that we deem to violate the above.
12. Links to Third-Party Sites
The Site may include links to other websites maintained by third parties. These links are provided to you solely as a convenience. Your access to these third-party websites is at your own risk, and we will have no liability arising out of or related to such websites or your access to or use of such websites.
13. Prohibited Uses of Site

You are obligated to immediately report a lost or stolen password or username to our Customer Service. 15. Disclaimer of Warranty & Limitation of Liability

17. Disputes
Given the high cost of legal dispute, not only in dollars but also in time and energy, both you and The Daily Grinder agree to the following dispute resolution procedure:
In the event of any controversy, claim, action or dispute, the party asserting the dispute shall first try to settle such dispute by providing written notice to the other party by registered mail describing the facts and circumstances (including any relevant documentation) of the dispute and allowing the receiving party 30 business days from the date of mailing to respond to the dispute.

Our products are intended for use by adults aged 21 or older. The statements on this Site have not been evaluated by the U.S. Food & Drug Administration (FDA). RETURN & REFUND POLICY

We value your business and strive to ensure every purchase meets your expectations.
Because we sell hemp-derived consumable and wellness products, certain restrictions apply to protect customer safety and comply with state and federal law.
Please review this policy carefully before making a purchase.
1. Eligibility for Returns
We want you to be completely satisfied with your order. However, due to the consumable nature of our products, returns are limited to specific situations:

Damaged or Defective Items – If you receive a product that is damaged, defective, or incorrect, please contact us within 7 days of delivery. Once verified, we’ll send a replacement or issue a refund.

Shipping Errors – If your order arrives incomplete or incorrect, notify us within 7 days of delivery so we can correct it promptly.

Unopened & Unused Non-Consumable Products – Certain non-consumable items (such as branded merchandise or accessories) may be eligible for return if unopened and unused within 14 days of delivery. A Return Authorization (RA) is required.
For health, safety, and compliance reasons, we cannot accept returns of any opened consumable hemp products, including CBD, THC-A, or other ingestible or smokable products.

All hemp-derived consumables are considered final sale once opened.
3. Return Process
To initiate a return or replacement request:

Include clear photos of the product and packaging if damaged or incorrect.

Wait for our response (within 3–5 business days) and RA instructions before shipping any product back.
Returns without authorization will not be accepted.
Unless the return is due to our error, the customer is responsible for return shipping.
4. Refunds
Once your return is received and inspected, you’ll be notified by email.
If approved:

Refunds will be issued within 7–10 business days to your original payment method.

Depending on your bank or card issuer, the credit may take several additional days to post.
Refunds will not be issued for:

5. Exchanges
If you received a defective or incorrect item, we’ll gladly exchange it for the same product (if available) or offer an equivalent replacement.
Exchanges are approved on a case-by-case basis once eligibility is verified.
6. Shipping Restrictions & Compliance
We currently ship only within the United States, and only to states where hemp-derived products (≤ 0.3% Δ9-THC) are legal.
It is your responsibility to know and comply with your state’s laws.
If an order is seized, refused, or returned due to state restrictions or law changes, we cannot issue refunds for those items.

7. Damaged Packages in Transit
If your order arrives visibly damaged, do not open or consume the contents.
Take clear photos of the packaging and contents, then contact us within 48 hours of delivery at Thedailygrinderllc@gmail.com.
We will file a claim with the carrier and arrange a replacement if necessary.
8. Order Cancellations
Orders may be canceled within 2 hours of placement, provided they have not yet been processed or shipped.
Once an order is processed or in transit, it cannot be canceled.
To request a cancellation, email us immediately with the subject line “Order Cancellation.”
9. Legal Compliance
All products sold by The Daily Grinder comply with the 2018 U.S. Farm Bill and the Virginia hemp regulations administered by the Virginia Department of Agriculture and Consumer Services (VDACS).
All products contain no more than 0.3% Δ9-THC on a dry-weight basis.
The Daily Grinder reserves the right to refuse or cancel any order that cannot be legally shipped to your jurisdiction.
